1. Who we are

ClearTheSample.com (“ClearTheSample,” “we,” “us”) is operated by Mathieu Carrier, an individual based in Quebec, Canada. Business registration number (NEQ): to be added upon registration. Contact: contact@silkvelvetrecords.com.

2. What ClearTheSample is

ClearTheSample provides research information about music sample clearance status, licensing history, and public domain status (“Research Content”), and a browser-based audio tool, Flip Lab, that lets users create new audio arrangements from recordings we have identified as being in the public domain in the United States (“Flip Lab”).

3. Research Content is not legal advice

All Research Content — including Public Domain determinations, clearance histories, and any “verdict” shown on a song page — reflects our own research as of the date stated on that page. It is provided for informational purposes only and does not constitute legal advice. Copyright status can be genuinely uncertain, research can be incomplete or become outdated, and laws differ by country. You are responsible for independently verifying the rights status of any work before using it commercially, and for confirming compliance with the laws of your own jurisdiction. We recommend consulting a qualified lawyer for anything with real commercial or legal stakes.

5. Your content and use rights

Recordings offered through Flip Lab have been identified by us, based on our own research, as being in the public domain in the United States as of the date noted on the relevant song page. You are responsible for confirming this remains accurate and for confirming the rules applicable in your own country, since public domain terms vary internationally and the recordings on this site are evaluated under US law only.

Audio you create using Flip Lab (a “flip”) is yours to use, including commercially, subject to your own responsibility to verify rights status as above. We do not claim ownership over flips you create. We are not responsible for how you use exported audio.

6. Account responsibilities

You’re responsible for keeping your login credentials secure and for activity on your account. Let us know promptly at contact@silkvelvetrecords.com if you believe your account has been compromised.

7. Prohibited use

You agree not to: attempt to circumvent token/payment controls; misrepresent research content as legal certainty to third parties; use the service to infringe on others’ rights; or attempt to disrupt, reverse-engineer, or abuse the service’s infrastructure.

8. Disclaimers and limitation of liability

The service is provided “as is.” To the maximum extent permitted by law, we disclaim warranties of any kind, and our liability for any claim arising from your use of the service is limited to the amount you paid us in the twelve months before the claim arose. Nothing in this section limits liability that cannot be limited under Quebec or Canadian law.

We may update these Terms from time to time. Material changes will be noted on this page with an updated date.

10. Governing law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein.
